Summary of the BEREC external Workshop on ex-ante regulatory experience concerning commitments, wholesale-only undertakings and commercial agreements review

In order to inform and report on the operators’ experience concerning the application of Article 76 on the regulatory treatment of new VHCN elements, Article 79 on commitments procedure, Article 80 on wholesale-only undertakings, as well as on the NRAs’ assessment of commercial agreements in the market analysis process, BEREC conducted an external workshop that took place on 11 April 2024, in a hybrid setting During the second part of the year, there will be another workshop on the topic, this time internal, where NRAs will be able to share their views. The findings of these workshops are meant to shape BEREC’s thinking into the opportunity of revising the Co-investment Guidelines and, wider still, the upcoming review of the functioning of the EECC.
