BEREC has adopted a BEREC Opinion on Phase II investigation (AT/2013/1442)

BEREC adopted a BEREC Opinion on Phase II investigation pursuant to Article 7 of Directive 2002/21/EC as amended by Directive 2009/140/EC on 3 June.

On3 May 2013 the European Commission informedthe Austrian NationalRegulatoryAuthority RTRand BEREC about its serious doubts considering that adraft measure concerning the wholesale terminating segments of leased lines (Market 6) in Austria would create a barrier to the internal market.

Following its role and rulesBEREC adopted its opinion, stating that the expressed serious doubts by the European Commission are justified. More specific information about the serious doubts of the European Commission and BEREC’s assessment can be found here.
