The broadband cost reduction directive (BCRD) aims to facilitate and incentivise the roll-out of high-speed electronic communications networks by promoting the joint use of existing physical infrastructure and by enabling a more efficient deployment of new physical infrastructure so that such networks can be rolled out at lower cost. The BRCD in particular contains rules with regard to access to existing physical infrastructure (Article 3), coordination of civil works (Article 5) and access to in-building physical infrastructure (Article 9). In case the involved parties are not able to reach an agreement or access is refused, either party is entitled to refer the issue to the competent national dispute settlement body (DSB). Since the determination of pricing terms is one of the more complex issues addressed by the BRCD it will be studied in more detail. The focus of the report is on pricing in cases Article 3 as it is the most relevant Article for most Member States (MSs).

The draft report is based on replies to a questionnaire from NRAs of 24 MSs (AT, BE, BG, HR, CY, CZ, DK, EE, FI, FR, DE, GR, HU, IE, IT, MT, NL, PL, PT, RO, SI, ES, SE, UK) in which the relevant regulations regarding access to existing physical infrastructure and to civil works have been transposed and are in place.
