Notice for the launch of the public consultation for the evaluation of the application of Regulation (EU) 2015/2120 and the BEREC Net Neutrality Guidelines

This public consultation is seeking stakeholders’ views regarding an evaluation of the application of the BEREC Net Neutrality Guidelines[1] (the “Guidelines”) in the context of the Net Neutrality Regulation[2] (the “Regulation”). You may consult the public consultation paper here.

The objective of this consultation is to gather information on how stakeholders have experienced the application of the Regulation, as provided for in the Guidelines, since 30 April 2016.

It is noted that early 2019 the Regulation itself will be evaluated by the European Commission[3].

In addition to the general aspects of the application of the Regulation and Guidelines, BEREC is especially interested in the experiences of stakeholders concerning impact of the Guidelines on the adoption of new technologies.

Stakeholder’s input will be used to prepare for a BEREC Opinion for the European Commission in relation to the mentioned evaluation of the Regulation. BEREC aims at publishing this Opinion at the end of 2018.

The public consultation is open from 14 March 16:00 CET until 25 April 17:00 CET 2018.

All stakeholders are invited to submit their contributions to the following e-mail address: 

[email protected] or via the BEREC online public consultation tool on https://consultations.berec.europa.eu/en/berec until the 25^th of April 17:00 CET 2018. When registering with the consultation tool, please indicate your name and/or the name of the organisation or company you represent.

E-mail attachments could be included only if considered absolutely necessary. The overall size of the e-mail (including attachments) should not be larger than 2 MB.

After submitting the contribution via e-mail, an automatic reply will be generated. If this confirmation e-mail is not received, the submission of the contribution was not successful and it should be submitted again.

We strongly encourage all stakeholders to submit their contributions as early as possible. Contributions received after the above mentioned deadline will not be taken into account.

Contributions should preferably be sent in English.

This public consultation is organised mainly in BEREC online public consultation platform   https://consultations.berec.europa.eu/en/berec in a way that allows participants to submit their comments, to vote in favour or against or to upload their public or confidential files in every section.

It also provides the possibility to download the “word” consultation document for organisations and stakeholders that would like to share it with their partners to consolidate their views and comments in a single file input.

This single file input can be also uploaded on the platform in the last paragraph’s comment, ensuring again the classification of this input as public or confidential using the button “Make your contribution Confidential”.

However, in case you send your comments by e-mail, your answers should be organised according to the requested structure (i.e. paragraph by paragraph) in order to facilitate processing the responses.

All contributions will be published on the BEREC website, taking into account requests for confidentiality and publication of personal data. Any such requests should be clearly indicated: on the online platform by using the button “Make your contribution Confidential” or, if submitted via e-mail, by clearly stating which information is considered confidential.

Please note that it is also possible to submit both a confidential and a public version of your contribution.
