BEREC Members with voting rights and Participants without voting rights
The National Regulatory Authorities (NRAs) which are part of the Body of European Regulators for Electronic Communications (BEREC) can be differentiated into Members with voting rights and Participants without voting rights.
In accordance with Article 7 of Regulation (EU) 2018/1971 establishing the Body of European Regulators for Electronic Communications (BEREC) and the Agency for Support for BEREC (BEREC Office) – the BEREC Regulation – the Member States of the European Union (EU) have the right to vote and, thus, can be considered BEREC Members with voting rights. In accordance with Article 35(2) of the BEREC Regulation, BEREC must also be open to the participation of third country NRAs with primary responsibility in the field of electronic communications if they have entered into agreements with the EU to that effect. Those countries will participate without the right to vote in the work of BEREC and the Agency for Support for BEREC (BEREC Office) and, thus, can be considered Participants without voting rights.
Moreover, the European Commission participates in the deliberations of the Board of Regulators (BoR) without the right to vote. The BoR may also invite distinguished experts in their field to participate in meetings. They are not to be confused with Participants without voting rights.
