Public consultation on the draft BEREC Guidelines to foster the consistent application of the criteria for assessing co-investments in new very high capacity network elements (Article 76 EECC)

16 June 2020

During its 43rd (virtual) plenary meeting (11-12 June 2020), the BEREC Board of Regulators has approved the draft BEREC Guidelines to foster the consistent application of the criteria for assessing co-investments in new very high capacity network elements (Article 76 EECC) for public consultation.

BEREC is required under Article 76 of the European Electronic Communications Code (EECC) to publish guidelines to foster the consistent application by National Regulatory Authorities (NRAs) of the conditions to be met when assessing co-investment offers. The rationale for issuing these Guidelines is to contribute to the consistent application by NRAs of the conditions with which co-investment offers must comply when commitments associated with those offers are being assessed by the NRAs in the context of Article 76 of the EECC. Therefore, the envisaged Guidelines are to facilitate the consistent application of the minimum criteria for assessing the relevant co-investment project.

The public consultation will run from 16th June 2020 to 4th September 2020.

All stakeholders are invited to submit their contributions by 4th September 2020 14:00 CEST to the following e-mail address:  Art76EECC_Guidelines@berec.europa.eu. Further enquiries about the consultation may also be submitted to this e-mail address.

Stakeholders are not limited by any number of words in their replies, however, the overall size of the e-mail (including attachments) should not be larger than 2 MB.

Contributions should be sent preferably in English and include clear references to the relevant paragraphs or sections of the Guidelines in order to facilitate the processing of the responses. Comments in track changes in the available MS Word format file are also possible.

After submitting the contribution via e-mail, an automatic reply will be generated. If this confirmation e-mail is not received, the submission of the contribution was not successful and it should be submitted again.

We strongly encourage all stakeholders to submit their contributions as early as possible. Contributions received after the above-mentioned deadline will not be taken into account.

In accordance with the BEREC policy on public consultations, BEREC will publish a summary of all received contributions, respecting confidentiality requests.

All contributions will be published on the BEREC website, taking into account requests for confidentiality and publication of personal data. Any such requests should clearly indicate which information is considered confidential.

Please note that it is also possible to submit both a confidential and a public version of your contribution to the same e-mail address: Art76EECC_Guidelines@berec.europa.eu
