1.What personal data do we collect?

- Name(s) and surname(s);

- Profession;

- Position;

- Postal and e-mail addresses;

- Phone number;

- Fax number.

2. For what purpose do we collect personal data and on which legal basis?

The objective of the public consultations is to gather the views of stakeholders concerning topics defined in the BEREC Work Programme and to publish these views on the BEREC website.

BEREC Office collects the views of stakeholders during the period of public consultations which is normally 20 working days of the date of publication of the notice.

The legal bases of processing operation are:

  • Article 5 (1) (a) of Regulation 2018/1725 (processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the BEREC Office);
  • Article 4 (3) and4 (5)  of Regulation 2018/1971 (‘the BEREC Regulation’)

3.Who may receive your personal data?

Externally, received non-confidential contributions will be published on the BEREC web site, together with the personal data typically provided by the contributors as specified above, unless the contributor objects to publication of his/her personal data. In this case please provide a version of your reply for the website. Contributions having been submitted anonymously will not be published nor will, in principle, its content be taken into account.

Internally, your e-mail will be stored in the pm@berec.europa.eu mailbox. Confidential and non-confidential contributions will be transferred for the purpose of their assessment to a dedicated folder located on the BEREC Office shared drive as well as to the BEREC Chair’s Office and/or to the relevant BEREC Working Group, in accordance with the responsibility for the topic which is subject to a public consultation. Please note that a non-confidential contribution will be assessed in the form in which it will be published on the Internet. In case of a confidential contribution, all personal data will be removed before the contribution is assessed.

Please note that even if you request anonymous publication, your contribution may be subject to a request for access to documents under Regulation 1049/2001. In such cases, the request will be assessed against the conditions set out in the Regulation and in accordance with applicable data protection rules.

4. How long are your personal data kept?

Personal data will remain in the pm@berec.europa.eu mailbox until the results of public consultations have been completely analysed. They will be removed at the latest within 6 months from the end of the public consultation.

The published non-confidential contribution will be kept for 5 years. Then they are archived for permanent preservation.

5. What are your rights?

You have the right to request from the controller access to and rectification or erasure of your personal data or restriction of processing.

You also have the right to object to processing of your personal data.

The controller shall provide information on action taken on a request within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests.

6. Who is the data controller and how to exercise your rights?

The BEREC Office shall exercise the tasks of the data controller for the purpose of these processing operations.
