Review of the Internal Guidelines for the elaboration of BEREC Opinions in Article 7/7a Phase II cases

Within the European regulatory framework, Article 7/7a procedures play an essential role in order to promote the single market for electronic communications and to provide guidance to NRAs in the application of the framework. For this reason, BEREC has always paid particular attention to all aspects of Article 7/7a notifications and, in particular, to Article 7/7a Phase II cases. In 2015 BEREC undertook an analysis of Article 7/7a Phase II cases aimed at assessing how well the Article 7/7a process had been working. Within this context, the Remedies Expert Working Group developed a comprehensive database of all Phase II cases and conducted a survey among Phase II case team participants in order to gain a better understanding of all procedural and substantial aspects of the Article 7/7a process.
